These Terms & Conditions apply to purchases made through the Sunday Pair website.

By placing an order with us, you agree to these Terms & Conditions. Please read them carefully before completing your purchase.

Nothing in these Terms affects your statutory rights under UK consumer law.

2. Our products

We take reasonable care to ensure that product descriptions, photographs, colours, sizes, materials and other information shown on our website are accurate.

However:

  • colours may appear slightly different depending on your screen or device;
  • handmade, woven, printed or manufactured products may have minor variations;
  • packaging may occasionally differ from the images shown; and
  • measurements may be approximate where stated.

These minor differences do not affect your statutory rights where goods are faulty, materially different from their description or otherwise do not meet legal requirements.

3. Product availability

All products are subject to availability.

Adding an item to your basket does not reserve it.

We may limit quantities, withdraw products or refuse unusually large quantities where reasonably necessary, including where we suspect:

  • resale activity;
  • fraudulent activity;
  • pricing abuse;
  • misuse of promotional offers; or
  • a stock or system error.

If an item becomes unavailable after you place an order, we will contact you and refund any amount paid for the unavailable item.

4. Prices

All prices are shown in pounds sterling (GBP) unless otherwise stated.

The price payable is the price shown at checkout when you place your order.

Delivery charges, where applicable, will be displayed before payment is completed.

If Sunday Pair becomes VAT registered, prices will be presented in accordance with applicable VAT requirements.

5. Pricing and website errors

We take reasonable care to ensure that prices and product information are accurate.

Occasionally, an obvious pricing, description, promotional or technical error may occur.

If we identify an error before accepting or dispatching your order, we may contact you to:

  • confirm whether you wish to proceed at the correct price or on the correct terms; or
  • cancel the affected item or order and issue a full refund.

Nothing in this section allows us to avoid a contract unfairly once a binding agreement has already been formed.

6. Placing an order

To place an order, follow the checkout process on our website.

You are responsible for checking your order carefully before submitting it, including:

  • products;
  • quantities;
  • sizes or variants;
  • delivery address; and
  • contact information.

You will have an opportunity to review and correct information before completing your order.

Placing an order means you are making an offer to purchase the selected goods.

7. Order acceptance

After you place an order, you may receive an automated acknowledgement email.

This confirms that we have received your order but does not necessarily mean that your order has been accepted.

A contract is normally formed when we confirm acceptance of your order or dispatch the goods, depending on the wording of the confirmation provided to you.

We reserve the right to refuse or cancel an order before acceptance where there is a legitimate reason, including:

  • the product is unavailable;
  • payment cannot be authorised;
  • there is an obvious pricing or listing error;
  • delivery restrictions apply;
  • we reasonably suspect fraud or misuse; or
  • the order breaches these Terms.

Where payment has already been taken for an order that we validly cancel, we will refund the relevant amount.

8. Payment

Payment must be made using one of the payment methods made available at checkout.

Your order will not normally be dispatched until payment has been successfully authorised.

Payment processing may be handled by Shopify Payments or other third-party payment providers.

We do not directly store your full payment card details.

9. Promotions and discount codes

From time to time, Sunday Pair may offer discounts, promotional codes or special offers.

Unless otherwise stated:

  • promotions cannot be exchanged for cash;
  • only one promotional code may be used per order;
  • promotions may have expiry dates or minimum-spend requirements;
  • promotions may exclude certain products; and
  • promotional codes must be entered before checkout is completed.

We may withdraw or amend a promotion where reasonably necessary, but this will not affect orders already validly accepted.

We may cancel or refuse transactions involving obvious promotional abuse, fraud or unauthorised duplication of discount codes.

10. Delivery

Delivery options, estimated delivery times and charges are shown at checkout.

Delivery dates and times are estimates unless expressly stated otherwise.

We are not responsible for delays caused by circumstances outside our reasonable control, although your statutory rights remain unaffected.

11. Risk and ownership

Risk in the goods passes to you when the goods are delivered to you or to a person identified by you to receive them, subject to applicable consumer law.

Ownership of the goods passes to you once we have received full payment.

12. Cancellations, returns and refunds

Your rights to cancel an online order and return goods are explained in our Returns & Refunds Policy.

UK consumers generally have cancellation rights for many distance purchases, subject to applicable exceptions.GOV.UK

Nothing in these Terms limits your statutory rights in relation to faulty, damaged or misdescribed goods.

13. Faulty goods

We are legally responsible for supplying goods that conform to the contract.

If goods are faulty, not as described or otherwise fail to meet applicable legal standards, you may have rights to a refund, repair or replacement depending on the circumstances.

Any attempt in consumer terms to exclude responsibility for faulty or misdescribed goods would generally be unenforceable.GOV.UK

14. Your responsibility for information provided

You are responsible for ensuring that information supplied to us is accurate and complete.

This includes:

  • your name;
  • email address;
  • delivery address; and
  • other order information.

If you notice an error after placing your order, please contact us as soon as possible.

We cannot guarantee that delivery details can be changed after an order has been dispatched.

15. Fraud and misuse

We reserve the right to investigate and, where appropriate, refuse, cancel or restrict transactions where we reasonably suspect:

  • fraud;
  • unauthorised payment use;
  • deliberate damage;
  • false claims;
  • repeated abusive return behaviour;
  • misuse of promotional offers; or
  • other unlawful or abusive activity.

Any action taken under this section will be reasonable and will not remove rights that a consumer has under applicable law.

16. Intellectual property

Unless otherwise stated, all content on the Sunday Pair website, including:

  • branding;
  • logos;
  • photographs;
  • graphics;
  • written content;
  • product names;
  • website design; and
  • other original material

is owned by or licensed to Sunday Pair.

You may view and use our website for personal, non-commercial purposes.

You may not copy, reproduce, distribute, modify, commercially exploit or use our content without permission, except where permitted by law.

17. Website use

You must not misuse our website.

This includes attempting to:

  • interfere with website security;
  • introduce malicious software;
  • gain unauthorised access;
  • scrape or harvest data unlawfully;
  • interfere with checkout or pricing systems; or
  • use the website for fraudulent or unlawful purposes.

We may restrict access where reasonably necessary to protect the website, customers or our business.

18. Third-party services

  • delivery providers;

Nothing in these Terms excludes or limits liability for:

  • any other liability that cannot lawfully be excluded.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed, subject to applicable consumer law.

These Terms do not affect your statutory consumer rights.

20. Events outside our reasonable control

We will not be responsible for delay or failure caused by events outside our reasonable control.

These may include:

  • severe weather;
  • transport disruption;
  • strikes;
  • carrier disruption;
  • internet or infrastructure failure;
  • government action; or
  • other exceptional circumstances.

Where such an event affects your order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.

22. Changes to these Terms

We may update these Terms from time to time to reflect:

  • changes in our business;
  • changes to our website;
  • changes in applicable law; or

The Terms applying to your purchase will normally be those in force when you place your order.

These Terms are governed by the laws applicable in the United Kingdom.

If you are a consumer, you may also have the benefit of mandatory consumer protections and rights to bring proceedings in the courts available to you under applicable law.
